Notice Title

Notice of Acceptance of Industry Body Recommendation on Amending Schedule 1 of the Gas Governance (Critical Contingency Management) Regulations 2008

Following consideration of a recommendation from the Gas Industry Company Limited that I received on 7 December 2023, and in accordance with section 43ZP of the Gas Act 1992, I give notice that I have accepted the recommendation to amend the Gas Governance (Critical Contingency Management) Regulations 2008. The amendment will remove the Broadlands and Taupo gas gates from the critical contingency threshold limits in Schedule 1 of the Gas Governance (Critical Contingency Management) Regulations 2008. In addition, the amendment will be made pursuant to section 43F(2)(e) of the Gas Act 1992, and in accordance with sections 43I to 43P of that Act (as applicable).

I have accepted the recommendation because it:

  • will support sound arrangements for the management of critical contingencies by avoiding declaring a critical contingency event when planned new normal operational changes in part of the gas transmission system are implemented; and
  • is in the public interest as it will avoid unnecessary use of resources and time associated with declaring a critical contingency event while supporting the integrity of the critical contingency management regime because it will avoid declaring an unnecessary critical contingency event.

Issued at Auckland this 17th day of February 2024.

Hon SIMEON BROWN, Minister for Energy.
