Alternative Constitution for the Rise UP Academy (879) Board

1. Pursuant to clause 4 of Schedule 22 to the Education and Training Act 2020 (“Act”), I hereby approve an alternative constitution for the Rise UP Academy (879) Board.

2. The Rise UP Academy (879) Board (“board”) will be made up of the following members:

  1. Two parent representatives;
  2. the Principal;
  3. one staff representative; and
  4. up to three members appointed by Rise UP Trust.

3. Despite clause 5 of Schedule 22 to the Education and Training Act 2020, the following sections of the Education and Training Act will apply where relevant:

Schedule 22 – Clauses 1 and 2 

Schedule 23 – Clauses 1, 3, 8, 12 and 13 

4. Elections required under this notice for parent and staff representatives, will be carried out under the Education (Board Election) Regulations 2022 (“election regulations”). A returning officer will be appointed by the board for each election and will carry out the duties of the role in accordance with the election regulations.

5. The first election for the parent and staff representative will occur on 2 April 2025 and subsequent elections will be in 2028 and triennial thereafter.

Members appointed by Rise UP Trust 

6. Rise UP Trust may appoint eligible members for a term of office of up to three years.

7. Casual vacancies for appointed board members must be notified promptly by the board and such vacancies filled by appointment in the same manner as the vacating board member was appointed.

Transitional arrangement:

8. This alternative constitution will take effect on the date of publication. 

9. The establishment board are to stay in office until the elections are held for the parent and staff representatives.

10. The date for the elections for the parent representatives and staff representative is set as 20 November 2024.

11. The first meeting of the Rise UP Academy (879) School Board under this alternative constitution is fixed as 2 April 2025. The first members elected or appointed under this constitution will take office on this date.

12. The establishment board will:

  1. Notify the date of the first Board meeting to Rise UP Trust, which may appoint up to three trustees prior to that date; and 
  2. Leave office at the end of the day before the date of the first Board meeting set above on which the new board members take office.

13. Changes to this constitution will be subject to the approval of the Minister of Education and must be notified in the New Zealand Gazette.

This alternative constitution will take effect on the date of publication.
