Pursuant to section 60 of the Fisheries Act 1996, the Minister for Oceans and Fisheries, after complying with that section, gives the following notice.

Notice

1. Title

This notice is the Fisheries (Quota Aggregation Limit Exemption) Notice 2024.

2. Commencement

This notice shall come into effect on the day after its notification in the New Zealand Gazette.

3. Consent to hold Quota in excess of the Quota Aggregation Limit

From the date that this notice comes into effect, consent is given for the Geoff and Kath Pacey Family Trust (9900756), to exceed 45% of the combined total allowable commercial catches for New Zealand waters of Deepwater Clam (PZL), as set out in Schedule 5 of the Fisheries Act 1996, by 1.23% being a total up to 46.23%.

4. Condition

The consent given in clause 3 of this notice is subject to the following condition being met:

All quota shares held by Geoffrey William Pacey and Kathryn Raechal Pacey, including by any other entity in which they hold an interest, must be transferred to the Geoff and Kath Pacey Family Trust (9900756).

5. Evidence of Satisfaction of Condition

To evidence the consent condition has been satisfied, Fisheries New Zealand must receive formal notification from the Geoff and Kath Pacey Trust that the quota shares have been transferred to the Trust.
