Notice of Entry into Possession of Mortgaged Goods
In the matter of section 156 of the Property Law Act 2007 and in the matter of the mortgage over goods (a Business Term Facility Agreement dated 13 June 2022 as most recently varied by Variation Disclosure dated 8 August 2023 and a Specific Security Agreement dated 6 July 2023) (“Mortgage”) over a 2016 Komatsu PC300LC-8 Loader, Serial No.: KMTPC191HGC064319; a 2019 Hawkeye Motorised Grapple, VIN: HEC-MK3-0819-0043; a 2020 Hawkeye Motorised Grapple, VIN: HEC-MK3-0920-0063; and a 1990 Madill 171 Swing Yarder, Serial No.: 17120 (“Collateral”).
Notice is hereby given that on 4 December 2024, Heartland Bank Limited (“Mortgagee”) entered into possession of the Collateral following the failure of the mortgagor, RML Lease Limited (in liquidation) to comply with the terms of the Mortgage.
The registered office of the Mortgagee is Level 3, Heartland House, 35 Teed Street, Newmarket, Auckland.
