Notice of Entry Into Possession of Mortgaged Goods
In the matter of section 156 of the Property Law Act 2007 and in the matter of the Mortgage over goods (a Business Revolving Credit Facility Agreement dated 20 May 2022, a Two Commercial Loan Facility Agreements dated Agreement dated 20 May 2022, a Business Term Facility Agreement dated 20 May 2022 as most recently varied by Variation Disclosure dated 18 August 2023, a Commercial Loan Facility Agreement dated 26 January 2023, and a Commercial Loan Facility Agreement dated 24 May 2023 and a General Security Agreement dated 31 May 2022) (“Mortgage”) over a 2014 Volvo FH16 Articulated truck Registration No. LEW901, VIN: YV5RP80D6ED200359 (“Collateral”).
Notice is hereby given that on 17 October 2024, Heartland Bank Limited (“Mortgagee”) entered into possession of the Collateral following the failure of the mortgagor, JTS Transport Limited (in liquidation) to comply with the terms of the Mortgage.
The registered office of the Mortgagee is Level 3, Heartland House, 35 Teed Street, Newmarket, Auckland.
