Notice of Entry into Possession of Mortgaged Goods
In the matter of section 156 of the Property Law Act 2007 and in the matter of the Mortgage over goods (the Business Term Facility Agreement dated 6 December 2022 (“Mortgage”)) over a Ziva Modular Frame, Evolt 360 Body Composition Analyser, Lenovo TB-X505F Tablet, Portable Reception Desk, Panasonic 60” Smart TV, 3 x Matrix S-Drive C Treadmills, 3 x Concept2 SkiErg, 3 x Concept 2 Indoor Rowers, 3 x Synergy AIR Bionic Cycles, Canon PIXMA Printer, Gorilla 65” TV, 6 x ZIVA Benches, Pullman Advance Backpack Vacuum Cleaner, 3 x KEISER Spin Bikes, 6 x 65” KONIC TVs, Panasonic Microwave Oven, Nouveau Fridge and various gym equipment found on site such as medicine balls, boxing bags, barbells, kettlebells, foam matts, dumbbells and ropes. Full details of which can be obtained from the Mortgagee (“Collateral”).
Notice is hereby given that on 14 October 2024, Heartland Bank Limited (“Mortgagee”) entered into possession of the Collateral following the failure of the mortgagor, Go Fit Limited (in liquidation) to comply with the terms of the Mortgage.
Notice is further given that the Collateral is being sold by way of public auction from 10.00am on 1 November 2024 to 7.00pm on 7 November 2024.
