Public Notice of Entry into Possession of Mortgaged Goods
In the matter of section 156(1)(a)(ii) of the Property Law Act 2007 (“Act”) and in the matter of mortgage over goods dated 16 August 2021 (“2021 Loan”) and a Commercial Loan Facility Agreement dated 21 December 2022 (“2022 Loan”) (together, the “Security Agreements”) over the mortgaged goods described below.
Heartland Bank Limited (3152425), being the mortgagee under the Security Agreements (“Mortgagee”), gives notice in accordance with section 156(1)(a)(ii) of the Property Law Act 2007 that it has entered into possession of the mortgaged goods described below (“Collateral”) on 4 October 2024, following the failure of the mortgagor, Nixon Brothers Partnership (John Allen Nixon and David George Nixon), to comply with the terms of the Security Agreements.
