Notice of Entry Into Possession of Mortgaged Goods
In the matter of section 156 of the Property Law Act 2007 and in the matter of the Mortgage over goods (a commercial loan facility agreement dated 15 February 2021, a commercial loan facility agreement dated 11 May 2022, a commercial loan facility agreement dated 9 August 2022, a commercial loan facility agreement dated 9 January 2023, a commercial loan facility agreement dated 2 March 2023 and a commercial loan facility agreement dated 4 September 2023 most recently varied by variation disclosure dated 3 January 2024) (“Mortgage”) over a 2021 Sany SY215C Excavator, Serial No.: SY021BCA13008; 2019 Isuzu D-Max, Registration No.: MLA360, VIN: MPATFS85JJT011422; 2017 Isuzu F-Series, Registration No.: KLW474, VIN: JALFRR90JG7000220; 2019 CAT 320, VIN: CAT00320VHEX01932; 2015 Case 2050M WT Bulldozer, Serial No.: NFDC20079; and a 2021 Shacman X3000 Registration No.: NWP384, VIN: LZGJL4W49MX122214 (“Collateral”).
Notice is hereby given that on 3 September 2024, Heartland Bank Limited (“Mortgagee”) entered into possession of the Collateral following the failure of the mortgagor, Landwork Civil Limited (in liquidation) to comply with the terms of the Mortgage.
