Notice of Entry into Possession of Mortgaged Goods
In the matter of section 156 of the Property Law Act 2007 and in the matter of the Mortgage over goods (a Commercial Loan Facility Agreement dated 25 May 2021 (First Loan), a Commercial Loan Facility Agreement dated 3 February 2022 (Second Loan) and a Commercial Loan Facility Agreement dated 9 March 2022 (Third Loan)) (“Mortgage”) over: a 2021 SANY Clamp bucket, serial number: R10648; 2021 SANY 13.5 Ton Excavator, serial number: SY013QCB25888; 2021 SANY Excavator, serial number: SY007TCB59008; and a 2022 Pro-roll DR17 1.7T Roller, serial number: 21623062103 (“Collateral”).
Notice is hereby given that on 23 August 2024, Heartland Bank Limited (“Mortgagee”) entered into possession of the Collateral following the failure of the mortgagor, Ox Demolition Limited (in liquidation) to comply with the terms of the Mortgage.
The registered office of the Mortgagee is Level 3, Heartland House, 35 Teed Street, Newmarket, Auckland.
