This document notifies you that:

1. On 14 February 2024, the Samuel Marsden Collegiate School Trust Board (as trustee) filed an application in the High Court at Wellington for orders approving a scheme in respect of the Samuel Marsden Collegiate School Trust. Its reference number is CIV-2024-485-132.
2. If approved, the scheme will vary the trust deed to facilitate the administration of the trust. The scheme proposes to amend the relevant trust document to, among other things, permit that monies secured by way of mortgage or proceeds of sale of trust land may be applied to operational expenditure.
3. A copy of the scheme and the Attorney-General’s report on the scheme may be inspected at the High Court at Wellington, or at the offices of Mallett Partners as below.
4. The application is to be heard before the High Court at Wellington on Monday 15 April 2024 at 10.00am.
5. Any person who wishes to oppose the scheme must give seven clear days’ notice before the hearing, in writing, of their intention to do so, to:
1. the Registrar of the High Court at Wellington;
2. the Attorney-General, Crown Law Office, PO Box 2858, Wellington 6140 (to the attention of David Neild, Crown Counsel); and
3. the trustee of the Trust, whose address for service is the offices of Mallett Partners, Level 12/142 Featherson Street, Wellington 6011 (to the attention of Oliver Gascoigne).
