This document notifies you that:

  1. On 4 January 2024, an application dated 9 November 2023 under Part III of the Charitable Trusts Act 1957 for approval of a scheme in respect of a trust created by the Will of the late James Young was filed in the High Court at Christchurch. Its reference number is CIV-2024-409-19. The application is to be heard by the High Court at Christchurch on 15 April 2024 at 11.45am.
  2. If approved, the charitable scheme will vary a bequest of the estate which formed a testamentary charitable trust for the establishment and operation of a library at Sefton in North Canterbury and instead to apply those funds to assisting in the funding of a replacement of the Sefton Public Hall which was damaged in the Canterbury Earthquakes on the basis that this is the most closely aligned project in the Sefton area which would meet the deceased original purpose which was to provide a “library for the use of the residents of Sefton”.
  3. The Notice of Originating Application, supporting affidavits and the Attorney-General’s report may be inspected at the registry of the court or at the applicant’s address for service.
  4. The applicants are Denise Ann Lochhead of Sefton, Housewife, Lois Barbara Lochhead of Sefton, Retired and June Beryl Thompson of Christchurch, Teacher, as the current trustees of the trust established under the will of James Young whose address for service is c/- Helmores Lawyers (formerly Helmore Stewart) whose address is 9 Good Street, Rangiora 7400. The applicant’s solicitor is Craig William Knowles of the firm Helmores.
  5. Any person desiring to oppose the scheme must give written notice of their intention to do so to the Registrar of the High Court at Christchurch, Crown Law on behalf of the Attorney-General, and the applicant’s solicitor not less than seven clear days before 15 April 2024 (i.e., by 8 April 2024).
