Application for Approval of a Scheme to Vary Trust Pursuant to the Charitable Trusts Act 1957

Take notice that on 6 November 2023, Anthony Thomas Sullivan (“trustee”) filed an application in the High Court at Greymouth for orders approving a scheme varying the terms of the WILLIAM PATRICK SULLIVAN TRUST created pursuant to the will, dated 16 June 1947, of the late William Patrick Sullivan.

The scheme proposes to amend the relevant trust documents to, among other things, allow the trustee:

  1. To make payments towards the education and maintenance of students for the secular priesthood in the Roman Catholic Church or as Marist Brothers who will study anywhere in New Zealand and one of whose parents are, or were if deceased, New Zealand citizens or permanent residents;
  2. In the absence in any given 12-month period of a student or prospective student falling with the terms of category a. above, to make payments to seminarians in that particular year studying anywhere in New Zealand regardless of what country they may have come from or the citizenship and/or residency of either of their parents; and
  3. To have limited recourse to the capital of the trust fund to make such payments.

A copy of the scheme and a copy of the Attorney-General’s report on the scheme may be inspected at the High Court at Greymouth, or at the offices of Greg Kelly Trust Law as below, without payment of any fee.

The application is to be heard before the High Court at Greymouth on Tuesday, 23 April 2024 at 10.00am.

Any person who wishes to oppose the scheme must give seven clear days’ notice before the hearing, in writing, of their intention to do so, to:

  1. the Registrar of the High Court at Greymouth;
  2. the Attorney-General, Crown Law Office, PO Box 2858, Wellington 6140 (to the attention of Daniel Jones, Crown Counsel); and
  3. the trustee, whose address for services is the offices of Greg Kelly Trust Law at Level 6, 117 Lambton Quay, PO Box 25243, Wellington 6140 (to the attention of Kevin Lenahan).

This notice is advertised in accordance with section 36 of the Charitable Trusts Act 1957.
