Notice of Exemption Under the Health and Safety in Employment (Pressure Equipment, Cranes, and Passenger Ropeways) Regulations 1999

Pursuant to Regulation 6 of the Health and Safety in Employment (Pressure Equipment, Cranes, and Passenger Ropeways) Regulations 1999, I, Christopher John Thornborough, in exercise of powers delegated to me by WorkSafe New Zealand, hereby give notice of exemption from the requirements of Regulation 19(2)(a) of these Regulations for overseas manufacturers regarding fabrication inspection carried out by a recognised inspection body for passenger ropeways.

This exemption is subject to the following conditions:

  1. The manufacturer and their inspector(s) maintain an effective quality management system(s) accredited to ISO 9001,
  2. The manufacturer’s inspector(s) must be appropriately trained, experienced, and competent to complete such inspection works,
  3. The manufacturer’s inspector(s) must not have been involved in the fabrication of the equipment,
  4. The manufacturer provides documentation with the equipment demonstrating that it has carried out appropriate fabrication inspection under its accredited ISO 9001 quality management system with respect to the equipment, including all associated inspection reports,
  5. Manufacturing and fabrication inspection work must be performed and documented in accordance with the requirements of the relevant manufacturing standard, the Approved Code of Practice for Passenger Ropeways, and manufacturer and fabrication inspector’s quality management system(s).
  6. A copy of this exemption shall be included in the manufacturer’s documentation supplied with the equipment, including an explicit affidavit detailing how each condition (above) is complied with,
  7. This exemption shall remain in force for a period of five years, until 13 November 2029, unless cancelled in writing, and will be reviewed annually.
