Notice of Exemption Under the Health and Safety in Employment (Pressure Equipment, Cranes, and Passenger Ropeways) Regulations 1999

Pursuant to Regulation 6 of the Health and Safety in Employment (Pressure Equipment, Cranes, and Passenger Ropeways) Regulations 1999, I, Christopher John Thornborough, in exercise of powers delegated to me by WorkSafe New Zealand, hereby give notice of exemption from the requirements of these Regulations for design verification to be complete by a recognised inspection body for passenger ropeways.

This exemption is subject to the following conditions:

  1. The designer and their design verifier maintain an effective quality management system(s) accredited to ISO 9001,
  2. The designer’s design verifier(s) must be appropriately trained, experienced, and competent to complete such verification works,
  3. The designer’s design verifier(s) must not have been involved in the design of the equipment,
  4. The designer provides documentation with the equipment demonstrating that it has carried out thorough design verification under its accredited ISO 9001 quality management system with respect to the equipment,
  5. The design and design verification shall include explicit consideration to the New Zealand specific environmental factors,
  6. Design and design verification work must be performed and documented in accordance with the requirements of the relevant manufacturing standard, the Approved Code of Practice for Passenger Ropeways, and the designer and design verifier’s quality management system(s).
  7. A copy of this exemption shall be included in the designer’s documentation supplied with the equipment, including an explicit affidavit detailing how each condition (above) is complied with,
  8. This exemption shall remain in force for a period of five years, until 13 November 2029, unless cancelled in writing, and will be reviewed annually.
