In accordance with section 11 of the Electricity Industry Act 2010 (“Act”), the Electricity Authority gives the following notice.

Notice

1. Title and Commencement

(1) This notice is the Electricity Industry (Exemption No. 349 (Orion New Zealand Limited)) Exemption Notice 2024.

(2) This notice comes into force on the day after the date it is notified in the New Zealand Gazette.

2. Exemption

(1) Orion New Zealand Limited (“Orion”) is exempted from complying with the obligations in clause 10.25(1) of the Electricity Industry Participation Code 2010 (“Code”), subject to the conditions that Orion:

  1. establishes a new embedded network NSP at the point between the Electricity Ashburton Limited (EASH) embedded network and Orion’s Manuka Point embedded network by 31 December 2024, and
  2. ensures that washups for the NSP are provided to the reconciliation manager at least once every 14 months.

(2) This exemption applies only to the new Orion NSP at the connection between the Electricity Ashburton embedded network and Orion’s Manuka Point embedded network.

3. Term

(1) This exemption expires on the earlier of:

  1. 15 years; or
  2. when the line from Orion’s NSP to Manuka Point is upgraded, replaced or decommissioned.

4. Reasons for granting the exemption

(1) The reasons for granting this application are:

  1. the proposed exemption meets the requirements in section 11(2) of the Electricity Industry Act 2010 for granting exemptions
  2. the small number of ICPs involved mean there would be little or no impact on other participants
  3. there is in place a materially accurate method to calculate consumption for settlement.
