Notice of Appointment of Administrator

Notice is given that on 10 April 2024 at 2.00pm the board of MULTIPACK NZ LIMITED (administrator appointed) resolved, pursuant to section 239I of the Companies Act 1993 (“Act”), to appoint Grahame Ward, Licensed Insolvency Practitioner (IP134) of Sydney, New South Wales 2000, Australia, as administrator of the company (“the administrator”).

Notice of Meeting of Creditors

The first meeting of creditors of the company as prescribed by section 239AN of the Act will be held at Lane Neave, Level 8, Vero Tower, 48 Shortland Street, Auckland on Monday, 22 April 2024 commencing at 10.00am.

The purpose of the meeting is to:

  1. Decide whether to appoint a creditors’ committee and, if so, to appoint its members.
  2. Decide whether to replace the administrator.
  3. Receive and consider the directors’ statement of the company’s position.
  4. Submit and consider an overview of the conduct of the administration.

Notice to Secured Creditors

Pursuant to sections 239ABC and 239ABL of the Act, notice is given that any person who holds a charge over the whole, or substantially the whole, of the company’s property, has 10 working days from the date of the administration to enforce its security, failing which it will lose its opportunity to do so, without specific leave of the administrator or the High Court.

Notice of Appointment of Agent

Notice is given that, pursuant to section 239V(2)(c) of the Act, the administrator has appointed Stephen Mark Lawrence (Licensed Insolvency Practitioner (IP67)) and Christopher Carey McCullagh (Licensed Insolvency Practitioner (IP39), both of PKF Corporate Recovery and Insolvency (Auckland) Limited, jointly and severally to act as agent for the administrator, to do anything that the administrator has power to do.
