Notification of Amendments to Input Methodologies for Electricity Lines Services, Gas Pipeline Services, and Specified Airport Services—Input Methodologies Review 2023

The Commerce Commission (“Commission”) gives notice that it has amended the input methodologies (IMs) applicable to electricity lines services, gas pipeline services, and specified airport services. The amendments are secondary legislation made under Part 4 of the Commerce Act 1986 (“Act”) and the Legislation Act 2019.

The amended IMs are:

  • Commerce Act (Specified Airport Services Input Methodologies) Determination 2010 (Commerce Commission Decision 709, 22 December 2010);
  • Electricity Distribution Services Input Methodologies Determination 2012 [2012] NZCC 26;
  • Gas Distribution Services Input Methodologies Determination 2012 [2012] NZCC 27;
  • Gas Transmission Services Input Methodologies Determination 2012 [2012] NZCC 28;
  • Transpower Input Methodologies Determination [2012] NZCC 17; and
  • Transpower Capital Expenditure Input Methodology Determination [2012] NZCC 2.

The amendments are set out in:

  • Electricity Distribution Services Input Methodologies (IM Review 2023) Amendment Determination 2023 [2023] NZCC 35;

  • Gas Transmission Services Input Methodologies (IM Review 2023) Amendment Determination 2023 [2023] NZCC 36;
  • Transpower Input Methodologies (IM Review 2023) Amendment Determination 2023 [2023] NZCC 38; and
  • Transpower Capital Expenditure Input Methodology (IM Review 2023) Amendment Determination 2023 [2023] NZCC 39;

The amendments, which are secondary legislation, are made under the Legislation Act 2019 and Part 4 of the Act. The amendments result from the Commission’s review of IMs under s 52Y of the Act that commenced on 23 February 2022.

The amendments are made because they meet one or more of the three overarching objectives of the Commission’s review of IMs. The overarching objectives are to:

  • promote the purpose of Part 4 of the Act (section 52A) more effectively;
  • promote the purpose of IMs (section 52R) more effectively (without detrimentally affecting the promotion of the purpose of Part 4 of the Act); and
  • significantly reduce compliance costs, other regulatory costs, or complexity (without detrimentally affecting the promotion of the purpose of Part 4 of the Act).
