Notice of the Electricity Industry Participation Code Amendment (Clarification of Trader Obligations) 2023
1. Under sections 38 and 39(3) of the Electricity Industry Act 2010, and having complied with section 39 of that Act, the Electricity Authority gives notice of making the Electricity Industry Participation Code Amendment (Clarification of Trader Obligations) 2023 (“amendment”).
2. The amendment comes into force on 31 October 2023.

The amendment amends clause 11.8 and clause 17 of Schedule 11.1 of the Electricity Industry Participation Code 2010 (“Code”), by inserting “identifier” after “ICP” in a number of places, to clarify that the relevant Code obligations are those of the trader responsible for the ICP identifier. These amendments are intended to address circumstances where there are two traders trading at an ICP.
4. The Authority considers that these amendments are technical and non-controversial as they do not change the meaning of, or the rights and obligations imposed under, the relevant clauses.
5. The amendment is secondary legislation for the purpose of the Legislation Act 2019 and is administered by the Authority.
6. A copy of the amendment and the Code are available on the Electricity Authority’s website http://www.ea.govt.nz/code-and-compliance/the-code/.
7. A copy of the amendment and the Code may also be inspected free of charge or purchased from the Electricity Authority, Level 7, Aon Centre, 1 Willis Street, Wellington.
