Direction Under the Education and Training Act 2020 to All Education Entities in Auckland

Direction

Under section 654 of the Education and Training Act 2020 I direct the governing bodies of all education entities in Auckland to comply with the following requirements until 7 February 2023:

  1. Each governing body of a registered school, private training establishment, or institution in Auckland must ensure that the entity is closed for both physical attendance and instruction until 7 February 2023.
  2. Each governing body of a service provider in Auckland may allow any child whose parent needs them to attend the service physically to do so, but must otherwise ensure the service provider is closed to physical attendance until 7 February 2023.
  3. For the avoidance of doubt, the governing bodies of education entities in Auckland may continue to provide education through means that do not involve the physical attendance or instruction of students if they wish to do so.

This direction supports the response to, and recovery from, the state of local emergency declared in the Auckland Civil Defence Emergency Management Group Area on 27 January 2023 and I am satisfied that the making of it will mitigate the actual or potential adverse effects of the emergency, and facilitate co-ordinated processes among education entities and government agencies.

Interpretation

In this direction:

Terms in this direction that are defined in the Education and Training Act 2020 have the same meanings as defined in that Act.

Auckland means the Auckland Civil Defence Emergency Management Group Area established under the Civil Defence Emergency Management Act 2002.

Dated this 30th day of January 2023.

IONA HOLSTED, Secretary for Education.
