Notice of Watershed Meeting of Creditors to Decide the Companies’ Future

Pursuant to Section 239AU of the Companies Act 1993

Notice is given that:

1. Richard John Nacey and Stephen Robert White, both Licensed Insolvency Practitioners of PricewaterhouseCoopers (“PwC”), were appointed joint and several administrators (“Administrators”) of the companies by their sole director on 30 October 2023.
2. The watershed meeting of the creditors of the companies to decide the companies’ future will be held on Thursday, 9 November 2023 at 4.30pm. The meeting will be heard concurrently at the following location: Level 27, PwC Tower, 15 Customs Street West, Auckland 1010
3. The business to be dealt with at the Watershed Meeting is to:
1. Consider the Administrators’ report and opinion about the companies’ business, property, affairs and financial circumstances; and
2. Determine the future of the companies and to address any other business that may be lawfully brought forward.
4. The texts of the resolutions to be voted on at the watershed meeting are as follows and strictly in the following order:
1. That a Deed of Company Arrangement (DOCA) be approved; or
2. That the Companies should be placed into liquidation; or
3. That the Administration end and control of the companies be returned to the companies’ director.
5. Creditors may exercise their right to vote by being present in person, or by appointing a proxy or by postal vote. Postal votes must be received no later than 11.00am on Wednesday, 8 November 2023 and should be sent to: SUPIE LIMITED, BEVIE LIMITED and WORKERLY LIMITED (administrators appointed), C/- PwC, Private Bag 92162, Auckland 1010.
