Notice of Concurrent Meeting of Creditors

Pursuant to Section 243 of the Companies Act 1993

On 6 April 2023 it was resolved by special resolutions, pursuant to section 241 of the Companies Act 1993, that SCARBRO BUILD LIMITED and SCARBRO CONSTRUCTION LIMITED (collectively “the Companies”) be liquidated and that Andrew Grenfell and Conor McElhinney of Auckland, Licensed Insolvency Practitioners and chartered accountants be appointed as liquidators.

Notice is given that a concurrent meeting of creditors will be held by way of an assembly of creditors in the Takanini Room (Level 2 of the Ascot Stand), Ellerslie Event Centre at the Ellerslie Racecourse on Monday 22 May 2023 commencing at 1.00pm.

Business

The business to be transacted at the meeting is:

1. Update from the liquidators of the Companies’ affairs.
2. Confirm the appointment of Andrew Grenfell and Conor McElhinney as liquidators or resolve to appoint other liquidators in place of the present liquidators.
3. Consider whether to appoint a liquidation committee in either of the Companies, and if so to appoint members of that committee.
4. Consideration of whether to pass any other resolutions setting out views of creditors relating to the business of the meeting.
