The applicant described below has applied under section 115 of the Land Transfer Act 2017 for the removal of a right to convey water at the Hawke’s Bay Registration District. The applicant claims the right to convey water easement is redundant by reason of the circumstances set out below.

Easement: Water Rights over Lot 2 DP 568681 part marked D on DP 568681 Created by Transfer 74663 in Record of Title 1023203 (Burdened land) owned by Frederick Thomas Ellison and Stephen Hugh Orr Reaney for the benefit of Lot 1 DP 373109 in Record of Title 295529 owned by Antony Lee Van Weyer and Charlotte Anne Fisher.

Circumstances: The easement became redundant as part of the benefited land no longer adjoins the burdened land because of the subdivision shown on Deposited Plan 373109.
