Notice is given under section 173(1) of the Land Transfer Act 2017 of the following application to bring part of the dry bed of an unnamed stream under the Act and issue a record of title for it made under section 172(1)(a) of the Act.

Application 12699905.1 by Acklin Developments Limited and General Distributors Limited respectively, c/- Lane Neave Lawyers, 141 Cambridge Terrace Christchurch 8013, PO Box 2331 Christchurch 8140, for land near/off 16A Takapau Road (State Highway 2) between Harris and James Streets Waipukurau in the Central Hawke’s Bay District being 0.0547 and 0.0094 hectares more or less and shown as Lots 2 and 1 on LT Plan 581728, being part of the former bed of an unnamed stream adjoining Lot 3 DP 560151 and Lot 1 DP 389090 comprised in Records of Title 987808 and 356270 in the Hawke’s Bay Land Registration District. The applicants claim to have a right under the usque ad medium filum aquae presumption and there is no other person in possession of the land with a better claim.

A person specified in section 174(1) of the Act may lodge a caveat under that section to prevent the application from being granted before 18 December 2023. If no caveats are lodged, a record of title will be issued in the name of the applicants respectively.
