Notice is given under section 173(1) of the Land Transfer Act 2017 of the following applications to bring part of the dry bed of the Waiharakeke West Stream under the Act and issue a record of title for it made under section 172(1)(a) of the Act.

Application 11930267.6 by Russell Mervyn Laurence and Heather Kay Laurence and Application 11930267.7 by Jorobros Limited for land between Horrell Road Morrinsville and 4062A-4062B State Highway 27, Tatuanui in the Matamata-Piako District being, old streambed shown as part Lots 1 and 2 on LT Plan 495627 being part of the former bed of Waiharakeke West Stream adjoining Lot 1 Deposited Plan 388345 and Lot 8 Deposited Plan 8192, comprised in Records of Title 353541 and SA285/260, in the South Auckland Land Registration District.

The applicants claim to have a right under the usque ad medium filum aquae presumption and there is no other person in possession of the land with a better claim for title.

A person specified in section 174(1) of the Act may lodge a caveat under that section to prevent the application from being granted before 15 September 2023. If no caveats are lodged, a record of title will be issued in the name of the applicants.
