Notice is given under section 173(1) of the Land Transfer Act 2017 of the following application to bring the dry bed of an unnamed stream under the Act and issue a Record of Title for it made under section 172(1)(a) of the Act.

Application 12585229.1 by Cadtess Investments Limited, Craig Allan Korff and Debbie Joy Korff, c/- Bland & Jackson Surveyors, 19 Dawson Street, New Plymouth 4340 for land east of Princess Street, Waitara in the New Plymouth District being 0.0209, 0.0104, 0.0445, 0.1163, 0.0345, 0.0501 and 0.0412 hectares, more or less, and shown as Lots 1 to 7 on LT Plan 571356 respectively, being part of the former bed of an unnamed stream that adjoins and runs north of Waipapa Road (unformed) adjoining Lots 8, 9 and 10 on DP 540962 comprised in Record of Titles 908151 and 908147 in the Taranaki Land Registration District.

The applicants claim to have a right under the usque ad medium filum aquae presumption and there is no other person in possession of the land with a better claim for title.

A person specified in section 174(1) of the Act may lodge a caveat under that section to prevent the application from being granted before 10 July 2023. If no caveats are lodged, a Record of Title will be issued in the name of the applicants.
