Notice of Intention to Take land for Legal Road—Hastings District

Notice is hereby given that the Hastings District Council, under the provisions of section 23 of the Public Works Act 1981, proposes to take the land described in the Schedule to this notice (“Land”). The land is required for road.

The reasons why the Hastings District Council considers it reasonably necessary to take the Land are:

  1. To complete the “greenfield” ring road servicing the Howard Street Urban Development.
  2. To provide for the provision of services, being water, stormwater, sewer and an overland flow path to implement the Howard Street Urban Development.

The owner of the Land and those persons with a registered interest in the Land have been served with notice of the Hastings District Council’s intention to take the Land and advised of their rights to object.

Any other person having the right to object may send a written objection to the Registrar, Environment Court, Tribunals Division, Justice Department, Private Bag, Postal Centre, Wellington, within 20 working days after the publication of this notice.

If any objection is made in accordance with this notice, a public hearing will be held. The objector will have the right to appear and be heard personally unless the objector otherwise requires. Each objector will be informed of the time and place of the hearing.

Schedule

The land required to be taken at 216 Havelock Road, Hastings forms part of Lot 2 DP 579320 held in Record of Title 1081252, and has been defined as Section 7 on SO 584769 with an area of 1,632 square metres.
