New Zealand Transport Agency (Clean Vehicle Discount Scheme Repeal) Direction 2023

Pursuant to section 95(1)(t) of the Land Transport Management Act 2003 and sections 112 and 115 of the Crown Entities Act 2004, the Minister of Transport gives the following Direction.

Direction

1. Title

This Direction is the New Zealand Transport Agency (Clean Vehicle Discount Scheme Repeal) Direction 2023.

2. Commencement

This Direction comes into force on 1 January 2024.

3. Application

This Direction applies to the New Zealand Transport Agency (which is a Crown Entity pursuant to section 93 of the Land Transport Management Act 2003) (“Agency”).

4. Background

The Clean Vehicle Discount Scheme (“Scheme”) allowed consumers to receive a rebate on the first registration of zero- and low-carbon emission vehicles. The Agency administered these rebates as part of its function under section 95(1)(ma) of the Land Transport Management Act 2003. On 12 December 2023, Parliament passed the Land Transport (Clean Vehicle Discount Scheme Repeal) Amendment Bill, which following Royal Assent ceased the Scheme and repealed section 95(1)(ma). This Direction adds a function to the Agency to continue to process any rebate applications received before 1 January 2024.

5. Additional Functions

The Agency is directed to continue to administer the Scheme in respect of:

  1. administering rebate payments for applications received before 1 January 2024, and
  2. carrying out other actions necessary for the Scheme to be wound up before the close of 30 June 2024.

6. Expiry

This Direction expires with the close of 30 June 2024, but may be revoked at any time.
