Fisheries (Declaration of Mikonui Mātaitai Reserve) Notice 2023 (Notice No. MPI 1683)

Pursuant to regulation 22 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Director-General of the Ministry for Primary Industries gives the following notice.

1. Title

This notice is the Fisheries (Declaration of Mikonui Mātaitai Reserve) Notice 2023.

2. Commencement

This notice comes into force on the 28th day after the date of its notification in the New Zealand Gazette.

3. Declaration of Mikonui Mātaitai Reserve

(1) This notice declares the Mikonui Mātaitai Reserve.

(2) The area of the mātaitai reserve is the area of South Island fisheries waters within the following lines:

  1. starting at a point on the mean high-water mark near the mouth of the Mikonui River (at 42°54.208’S and 170°45.516E), then
  2. proceeding in a straight line in a north-westerly direction for approximately 0.5km to a point offshore (at 42°54.074S and 170°45.213E), then
  3. proceeding in a generally north-easterly direction along a line every point of which is approximately 0.5km from the mean high-water mark, for approximately 4.5 km, to a point offshore (at 42°52.624S and 170°47.738E), then
  4. proceeding in a straight line in a south-easterly direction to a point on the mean high-water mark, approximately 215m to the north-east of the end of Ross Beach Road (at 42°52.748S and 170°48.029E), then
  5. proceeding along the mean high-water mark in a generally south-westerly direction to the starting point.

4. Conditions Relating to Commercial Fishing in the Mikonui Mātaitai Reserve

(1) Fish taken commercially outside of the mātaitai can be processed inside the Mikonui Mātaitai Reserve.

(2) Commercial fishing vessels can anchor in the Mikonui Mātaitai Reserve.

(3) In this clause –

fish means all species of finfish and shellfish, at any stage of their life history, whether living or dead.
