Fisheries (Declaration of Tautuku Mātaitai Reserve) Notice 2023 (Notice No. MPI 1526)

Under regulation 22 of the Fisheries (South Island Customary Fishing) Regulations 1999, the Director-General of the Ministry for Primary Industries gives the following notice.

1. Title

This Notice is the Fisheries (Declaration of Tautuku Mātaitai Reserve) Notice 2023.

2. Commencement

This notice comes into force on the 28th day after the date of its notification in the New Zealand Gazette.

3. Declaration of Tautuku Mātaitai Reserve

(1) This notice declares the establishment of the Tautuku Mātaitai Reserve.

(2) The area of the mātaitai reserve is the area of South Island fisheries waters within the following lines:

  1. starting at a point on the mean high-water mark on the northern side of the Tautuku River mouth at 46°36.759’S and 169°25.834E; then
  2. proceeding in a straight line in a south-easterly direction to a point on the mean high-water mark on the north side of the Tautuku Peninsula at 46°35.980’S and 169°26.158’E; and
  3. includes the lower reaches of the Tautuku River up to the Chaslands Highway; and
  4. includes the lower reaches of the Fleming River between its confluence with the Tautuku River and up to the Chaslands Highway.

4. Conditions Relating to Commercial Fishing in the Tautuku Mātaitai Reserve

(1) Fish taken commercially from outside the mātaitai reserve may be landed within the mātaitai reserve.

(2) In this clause –

fish means all species of finfish and shellfish, at any stage of their life history, whether living or dead.
