Pursuant to section 48A(2A) of the Conservation Act 1987, the Taupo Fishery Regulations 2004, and section 14(11) of the Maori Land Amendment and Maori Land Claims Adjustment Act 1926, the Minister of Conservation, with the concurrence of the Tuwharetoa Maori Trust Board, gives the following notice.

1. Title

This is the Taupo District Trout Fishery Licences, Fees, and Forms Notice 2023.

2. Commencement

This notice comes into force on 1 July 2023.

3. Interpretation

In this notice, unless the context otherwise requires,—

24-hour licence means a licence that entitles the holder to take trout within the Taupo District (except at the Tongariro National Trout Centre or at Lake Rotoaira) during any 24-hour period that is stated in the licence.

adult means a person aged 18 years or over on 1 July, being the first day of the 12-month period, beginning on 1 July and ending on 30 June, that is stated in the licence.

child means a person who is aged under 18 years on 1 July, being the first day of the 12-month period, beginning on 1 July and ending on 30 June, that is stated in the licence.

Director-General means the Director-General of Conservation

family means—

1. 1 person, or 1 person and that person’s spouse or partner; and
2. the dependants of that person or those persons who—
1. ordinarily or periodically reside with that person or those persons; and
2. are aged under 18 years on 1 July; and
3. the grandchildren of that person or those persons, who are aged under 18 years on 1 July, being the first day of the 12-month period beginning on 1 July and ending on 30 June, that is stated in the licence.

family licence means a licence that entitles the holder and the holder’s spouse or partner and any member of the holder’s family, to take trout within the Taupō District (except at the Tongariro National Trout Centre or at Lake Rotoaira) during the 12-month period, beginning on 1 July and ending on 30 June, that is stated in the licence.

Lake Rotoaira means “the Lake” as defined in section 3 of the Maori Purposes Act 1959.

Lake Rotoaira 24-hour licence means a licence that entitles the holder to take trout within Lake Rotoaira during any 24-hour period that is stated in the licence.

Lake Rotoaira family licence means a licence that entitles the holder and the holder’s spouse or partner and any member of the holder’s family, to take trout within Lake Rotoaira) during the 12-month period, beginning on 1 July and ending on 30 June, that is stated in the licence.

Lake Rotoaira week licence means a licence that entitles the holder to take trout within Lake Rotoaira during the period of seven consecutive days that is stated in the licence.

Lake Rotoaira whole-season licence means a licence that entitles the holder to take trout within Lake Rotoaira during the 12-month period, beginning on 1 July and ending on 30 June, that is stated in the licence.

non-resident means a person who is neither a New Zealand citizen nor a permanent resident (as those terms are defined in section 4 of the Immigration Act 2009).

non-resident licence means a licence that entitles the holder to take trout within the Taupo District (except at the Tongariro National Trout Centre or at Lake Rotoaira) during the 12-month period, beginning on 1 July and ending on 30 June, that is stated in the licence.

partner means a civil union partner or a de facto partner.

senior means a person who is aged 65 years or older on 1 July, being the first day of the 12-month period, beginning on 1 July and ending on 30 June, that is stated in the licence.

supervisor adult means an adult who supervises a child who undertakes authorised fishing activities in the children’s fishing pond at the Tongariro National Trout Centre.

Taupo District means the district described in the Schedule of the Taupo District Order 1983.

Tongariro National Trout Centre licence means a licence that entitles the holder (either a child or a supervisor adult) to fish for trout at the Tongariro National Trout Centre, during the period that is stated in the licence.

trout includes char of any species, and any hybrid of any trout or char; and includes any trout whether alive or dead, and any part of a trout.

week licence means a licence that entitles the holder to take trout within the Taupo District (except at the Tongariro National Trout Centre or at Lake Rotoaira) during the period of 7 consecutive days that is stated in the licence.

whole-season means the 12-month period, beginning on 1 July and ending on 30 June.

whole-season licence means a licence that entitles the holder to take trout within the Taupo District (except at the Tongariro National Trout Centre or at Lake Rotoaira) during the 12-month period, beginning on 1 July and ending on 30 June, that is stated in the licence.

Licences and Fees

4. Director-General may issue licences

The Director-General may issue 1 or more of the following classes of licence:

1. 24-hour licence;
2. week licence;
3. whole-season licence;
4. senior licence;
5. non-resident licence;
6. family licence;
7. Lake Rotoaira 24-hour licence;
8. Lake Rotoaira week licence;
9. Lake Rotoaira whole season licence;
10. Lake Rotoaira family licence;
11. Tongariro National Trout Centre licence.

5. 24-hour licence

If the Director-General issues 24-hour licences, an adult or a child may apply to obtain a 24-hour licence from the Director-General on payment of the appropriate fee set out in Part 1 of the Schedule and the Director-General may grant or decline such a licence.

6. Week licence

If the Director-General issues week licences, an adult resident or an adult non-resident, as the case may be, may apply to obtain a week licence from the Director-General on payment of the appropriate fee set out in Part 2 of the Schedule and the Director-General may grant or decline such a licence.

7. Whole-season licence

If the Director-General issues whole-season licences, an adult or a child may obtain a whole-season licence from the Director-General on payment of the appropriate fee set out in Part 3 of the Schedule and the Director-General may grant or decline such a licence.

8. Senior licence

If the Director-General issues senior licences, an adult may apply to obtain a senior licence for the whole-season from the Director-General on payment of the appropriate fee set out in Part 3 of the Schedule and the Director-General may grant or decline such a licence.

9. Non-resident licence

If the Director-General issues non-resident licences, an adult may obtain a non-resident licence for the whole-season from the Director-General on payment of the appropriate fee set out in Part 3 of the Schedule and the Director-General may grant or decline such a licence.

10. Family licence

If the Director-General issues family licences, an adult may apply to obtain a family licence for the whole-season from the Director-General on payment of the appropriate fee set out in Part 3 of the Schedule and the Director-General may grant or decline such a licence.

11. Lake Rotoaira 24-hour licence

If the Director-General issues Lake Rotoaira 24-hour licences, an adult or a child may apply to obtain a Lake Rotoaira 24-hour licence from the Director-General on payment of the appropriate fee set out in Part 4 of the Schedule and the Director-General may grant or decline such a licence.

12. Lake Rotoaira week licence

If the Director-General issues Lake Rotoaira week licences, an adult or a child may apply to obtain a Lake Rotoaira week licence from the Director-General on payment of the appropriate fee set out in Part 5 of the Schedule and the Director-General may grant or decline such a licence.

13. Lake Rotoaira whole-season licence

If the Director-General issues Lake Rotoaira whole-season licences, an adult or a child may obtain a Lake Rotoaira whole-season licence from the Director-General on payment of the appropriate fee set out in Part 6 of the Schedule and the Director-General may grant or decline such a licence.

14. Lake Rotoaira family licence

If the Director-General issues Lake Rotoaira family licences, an adult may apply to obtain a family licence for the whole-season from the Director-General on payment of the appropriate fee set out in Part 6 of the Schedule and the Director-General may grant or decline such a licence.

15. Tongariro National Trout Centre licence

(1) If the Director-General issues Tongariro National Trout Centre licences, a supervisor adult may apply to obtain a Tongariro National Trout Centre licence from the Director-General on payment of the appropriate fee set out in Part 7 of the Schedule and the Director-General may grant or decline such a licence.

(2) If the Director-General issues Tongariro National Trout Centre licences, a child may apply to obtain a Tongariro National Trout Centre licence from the Director-General on payment of the appropriate fee set out in Part 7 of the Schedule and the Director-General may grant or decline such a licence.

16. Fees inclusive of GST

The fees set out in the Schedule are inclusive of goods and services tax.

Forms

17. Forms of licences

Every licence issued under this notice must be in writing and must state—

1. the holder’s full name, postal address, and date of birth:
2. whether the holder is an adult or a child:
3. the class and effect of the licence:
4. the time and date of issue:
5. the period during which the licence authorises the taking of trout.

18. Revocation

(1) The Taupo District Trout Fishery Licences, Fees, and Forms Notice 2021 (New Zealand Gazette, 13 May 2021, Notice No. 2021-go1814) is revoked.

Explanatory Note

This note is not part of the notice, but is intended to indicate its general effect.

This notice, which comes into force on 1 July 2023,—

• fixes the forms and classes of fishing licences within the Taupo District;
• fixes the scope and effect of those classes of licences; and
• fixes the fees payable for fishing licences in the Taupo District.

The fees have been set to recover the costs of management of the Taupo Fishery.

New licence categories have been introduced for Lake Rotoaira, for which fees are set at $0.00. Licences that used to cover the Lake Rotoaira area no longer do so.

This notice revokes the Taupo District Trout Fishery Licences, Fees, and Forms Notice 2021 (New Zealand Gazette, 13 May 2021, Notice No. 2021-go1814).
