Commencement of Periodic Review of the Designation of an Imprisoned Terrorist Entity
On 27 August 2020, Brenton Harrison Tarrant, born Grafton, Australia, on 27 October 1990, was designated as a terrorist entity in New Zealand pursuant to section 22 of the Terrorism Suppression Act 2002 (“TSA”).
On 10 May 2023 the Counter-Terrorism Acts (Designations and Control Orders) Amendment Act 2023 came into effect; this made amendments to the TSA designations scheme. While a designated terrorist entity is imprisoned, expiry of the entity’s designation is paused, and the Prime Minister must undertake a periodic review every three years to decide whether the designation is no longer justified.
The periodic review of the above-named entity’s terrorist designation has commenced.
The Prime Minister may decide a designation is no longer justified in a periodic review only if satisfied that none of its effects are necessary or desirable for the prevention, or other suppression, of terrorism.
The Prime Minister must consider any relevant information provided by third parties with an interest in the designation. Section 34 of the TSA provides that third parties may include those who have an interest in a designation apart from any interest in common with the public through—
