In accordance with sections 272E and 272F of the Building Act 2004, the Chief Executive of the Ministry of Business, Innovation and Employment (MBIE) hereby gives notice of her intent to make the following Product Certification (CodeMark) Scheme Rules. The proposed amendments are in response to sector feedback and include:

  • a requirement for product certification bodies (PCBs) to use the MBIE issued certificate template with the new mark of conformity.
  • a requirement for certificate holders to make technical information from CodeMark certificates easily accessible for the public.

The purpose of the proposed changes to the CodeMark scheme rules is to create further consistency across the scheme, and to support better informed decision-making and understanding by building consent authorities, building owners, builders and designers.

Transition arrangements

MBIE is proposing that all product certificates should either be switched over to the new certificate template at any time after 28 April 2023 or at the time of the certificate’s annual review. All certificates must be switched over to the new template by 1 September 2024, which is the date that scheme participants must have all new product produced and packaged with the new mark of conformity.

MBIE are proposing that CodeMark certificate holders must meet the proposed requirement to make product technical information accessible by 1 September 2023.

It is proposed that the new scheme rules will commence on 28 April 2023.

The Ministry of Business, Innovation and Employment (MBIE) seeks written submissions on the proposed rules and transition period for the new CodeMark mark of conformity.

Consultation will commence on 22 March 2023. Submissions must be made online or by email, post, or physical delivery by 5pm on 20 April 2023.
