In the matter of section 156 of the Property Law Act 2007 and in the matter of the mortgage over goods (a Business Support Facility Agreement dated 17 June 2020 and a Commercial Loan Facility dated 29 May 2019) (“mortgage”) over a 2013 Hyundai RC320LC-9 excavator (Serial Number: HHXHZ901TD0000360) with Satco Fell and Delimb head and a 2008 Hitachi ZX240LC-3 excavator Serial Number: HCM1V10025912 (“collateral”).
Notice is hereby given that on 18 January 2023, Heartland Bank Limited (“mortgagee”) entered into possession of the collateral following the failure of the mortgagor, TWJ Logging Limited to comply with the terms of the mortgage.
