Notice of Application for Approval of a Charitable Trust Scheme Under Part 3 of the Charitable Trusts Act 1957

Take notice that the trustees of the H & R WHITEHOUSE FUND (“Trust”) will apply to the High Court at Christchurch on 13 March 2023 at 11.45am for orders, under Part 3 of the Charitable Trusts Act 1957, approving a scheme to amend the terms of the trust deed to allow the Trustees to:

  • transfer the surplus of the Trust Fund to the Gillies McIndoe Research Institute (“Gillies Institute”); and
  • wind up the Trust, once the surplus of the Trust Fund has been transferred to the Gillies Institute.

Further particulars of the application may be obtained from the office of the applicants’ lawyers, Young Hunter.

The proposed scheme and the Attorney-General’s report are also available for inspection free of charge at the High Court at Christchurch.

Any person desiring to oppose the scheme is required to give written notice of his or her intention to do so no less than seven clear days before the date of the hearing to:

  • the Registrar of the High Court at Christchurch, DX WX10021, Christchurch;
  • the applicants, C/- Young Hunter, PO Box 929, Christchurch 8140 (Attention: Daniel Weatherley); and
  • the Attorney-General, C/- Crown Law Office, DX SP20208, Wellington (Attention: Peter Gunn / Taoran Li).

This notice is advertised in accordance with section 36 of the Charitable Trusts Act 1957.
