This document notifies you that:

  1. On 13 June 2023, an application under Part III of the Charitable Trusts Act 1957 for approval of a scheme in respect of a trust created by the Will of the late Marlayne Clarke was filed in the High Court at Hamilton. Its reference number is CIV-2023-419-156. The application is to be heard by the High Court at Hamilton on 4 October 2023 at 9.00am.
  2. If approved, the charitable scheme will vary a bequest of the estate residue left to the now defunct “Trevellyn Home for the aged in Hamilton” and substitute it for a bequest to Presbyterian Support (Northern) (CC21532) for the charitable purposes of the “Enliven Maximising Independence” programme in Hamilton.
  3. The Notice of Originating Application, supporting affidavits and the Attorney-General’s report may be inspected at the registry of the court or at the applicant’s address for service.
  4. The applicant is Public Trust as executor of the estate of the late Marlayne Clarke whose address for service is c/- Thomas Dewar Sziranyi Letts Lawyers. The applicant’s solicitor is Joshua Jordan Pietras of the firm Thomas Dewar Sziranyi Letts, whose address is Level 6, Forsyth Barr Tower, 45 Knights Road, Lower Hutt.
  5. Any person desiring to oppose the scheme must give written notice of their intention to do so to the Registrar of the High Court at Hamilton, Crown Law on behalf of the Attorney-General, and the applicant’s solicitor not less than seven clear days before 4 October 2023 (i.e., by 5.00pm, 26 September 2023).
