Advertisement of Application for Approval of a Scheme to Vary Trust Pursuant to the Charitable Trusts Act 1957

Take notice that on 1 May 2023, Douglas Alexander Mckay (as trustee) filed an application in the High Court at Christchurch for orders approving a scheme varying the terms of the W H HARGREAVES TRUST created pursuant to the will of the late William Hartley Hargreaves (“Trust”).

The scheme proposes to vary the Trust by introducing a trust deed for the Trust, which will include provisions for:

  1. a power of appointment / removal of trustees and a power to appoint special trust advisers;
  2. a minimum number of trustees (two); and
  3. distributions of Trust income and capital.

A copy of the scheme and a copy of the Attorney-General’s report on the scheme may be inspected at the High Court at Christchurch, or at the offices of the solicitors named below, without payment of any fee.

The application is to be heard before the High Court at Christchurch on Monday 19 June 2023 at 11.45am.

Any person who wishes to oppose the scheme must give seven clear days’ notice before the hearing, in writing, of his or her intention to do so, to:

  1. the Registrar of the High Court at Christchurch;
  2. the Attorney-General, Crown Law Office, PO Box 2858, Wellington 6140 (to the attention of Abbey Lawson, Crown Counsel);
  3. the trustees of the Trust, c/- Buddle Findlay, Level 4, 83 Victoria Street, Christchurch (to the attention of Laura Elliott and Kelly Paterson).

This notice is advertised in accordance with section 36 of the Charitable Trusts Act 1957.
