Notification of Commerce Commission’s Amendments to Determination of Default and Customised Price-Quality Regulation Applicable to Electricity Distribution Businesses

The Commerce Commission (“Commission”) gives notice that it has amended, under Part 4 of the Commerce Act 1986 (“Act”): the default price-quality path (“DPP”) applicable to regulated suppliers of electricity distribution businesses (“EDBs”) for the regulatory period 1 April 2020 to 31 March 2025, Powerco Limited (“Powerco”) for the regulatory period 1 April 2023 to 31 March 2025 and the customised price-quality path (“CPP”) applicable to Aurora Energy Limited (“Aurora”) for the CPP regulatory period 1 April 2021 to 31 March 2026.

The amended DPP and CPP are:

  • Electricity Distribution Services Default Price-Quality Path Determination 2020 [2019] NZCC 21; and
  • Aurora Energy Limited Electricity Distribution Customised Price-Quality Path Determination 2021 [2021] NZCC 3.

The amendments are set out in:

  • Electricity Distribution Services Default Price-Quality Path (Compliance Statement Due Date) Amendment Determination 2023 [2023] NZCC 3; and
  • Aurora Energy Limited Electricity Distribution Customised Price-Quality Path (Compliance Statement Due Date) Amendment Determination 2023 [2023] NZCC 4.

Mindful of the priority of Part 4 regulated industries to focus on providing essential goods and services to New Zealanders during the effects of Cyclone Gabrielle, the Commission has published these non-material amendment determinations to give EDBs not exempt from price-quality regulation, Powerco and Aurora more time to provide the Commission with their annual price-setting compliance statements for the assessment period commencing 1 April 2023.

These amendment determinations extend the due date for providing to the Commission the annual price-setting compliance statement (for the assessment period commencing 1 April 2023) to 19 April 2023.

These determinations are to come into force on 10 March 2023.

Copies of the DPP and CPP Amendment Determinations will be available on the Commission’s website and are available for inspection free of charge at the Commission (during ordinary office hours), or for purchase at a reasonable price at the Commission, 44 The Terrace, Wellington.
