In accordance with section 11 of the Electricity Industry Act 2010 (“Act”), the Electricity Authority gives the following notice.

1. Title and Commencement

(1)This notice is the Electricity Industry Exemption No. 342 Contact Energy Limited Exemption Notice 2023.

(2) This notice comes into force on 1 January 2024.

2. Exemption

(1) Contact Energy Limited (“Contact Energy”) is exempted from complying with the obligation in clause 10.24(c) of Part 10 of the Electricity Industry Participation Code 2010, in respect of the three metering installations at installation control point 0000032431HR99C (“ICP”).

3. Term

This exemption expires on the earlier of:

1. the close of 30 June 2024: or
2. the date the status of three new ICPs to be created for the three metering installations are changed to active status in the registry.

4. Reasons for Granting the Exemption

The reasons for granting this exemption are:

1. the exemption meets the tests in section 11(2) of the Electricity Industry Act (“Act”)
2. the applicant has agreed to implement an alternative solution to resolve the issue and the exemption is granted for a certain time period to implement the alternative solution
3. this connection is to be used rarely as a backup supply during network outages and failures
4. the derivation of submission information by subtraction from the metering installations is as accurate as it would be if it was derived using directly metered data
5. the requested exemption will have no impact on any other participant or service provider and will not affect any other Code provision.
