Notice of Exemption Under the Health and Safety in Employment (Pressure Equipment, Cranes, and Passenger Ropeways) Regulations 1999

Pursuant to Regulation 5 of the Health and Safety in Employment (Pressure Equipment, Cranes, and Passenger Ropeways) Regulations 1999, I, Paul Molloy, in exercise of powers delegated to me by WorkSafe New Zealand, hereby give notice that an exemption is granted to Obelisk Industrial Limited from those duties in Regulation 19(2)(a) of the PECPR Regulations, which require fabrication inspection to be completed by an equipment inspector.

This exemption applies only to pressure piping of AS 4343 Hazard Levels B, C, D and E.

This exemption is subject to the following conditions:

  1. Obelisk Industrial Limited shall retain its quality management system’s ISO 9001 accreditation.
  2. Obelisk Industrial Limited shall ensure that WorkSafe are provided and maintained with a current copy of its ISO 9001 accreditation certificate and scope at all times. Any changes to the scope of accreditation that may affect this exemption are considered to be significant changes that must be notified to WorkSafe as soon as the changes take effect.
  3. This exemption applies only to fabrication work performed by Obelisk Industrial Limited.
  4. Obelisk Industrial Limited inspectors must hold a current CBIP welding inspector’s qualification and be appropriately trained for the work to be undertaken.
  5. Obelisk Industrial Limited’s inspector must not have participated in the fabrication of the item under inspection.
  6. Inspection work must be performed and documented in accordance with the requirements of the relevant manufacturing standard, the Approved Code of Practice for Pressure Equipment (Excluding Boilers) or the Approved Code of Practice for the Design, Safe Operation, Maintenance and Servicing of Boilers as applicable, and Obelisk Industrial Limited’s quality management system.
  7. Copies of all inspection reports must be given to the equipment owner and be made available for perusal by the recognised inspection body responsible for certifying the equipment for service.
  8. A recognised inspection body must witness pressure testing of Hazard Level B pipework where such testing is a requirement of the relevant manufacturing standard.
  9. Equipment must have a Certificate of Design Verification, issued by a recognised inspection body, except where such certification is waived by the relevant Approved Code of Practice.
  10. This exemption shall remain in force for a period of five years, provided all conditions continue to be satisfied, and unless cancelled in writing. Application for continued exemption will be required on or before 19 September 2028.
