The Commerce Commission (“Commission”) gives notice that under Part 4 of the Commerce Act 1986 (“Act”), the Commission has determined and published the Electricity Distribution Information Disclosure (Non-material) Amendment Determination – June 2023 [2023] NZCC 12 (“Non-material Amendment Determination”).

Summary of the Non-material Amendment Determination

Under section 52Q of the Act, the Non-material Amendment Determination amends the Electricity Distribution Information Disclosure Determination 2012 [2012] NZCC 22 (“principal determination”) by:

• making non-material amendments to clarify the timing of certain disclosure requirements that were introduced in the Electricity Distribution Information Disclosure (Targeted Review Tranche 1) Amendment Determination 2022 [2022] NZCC 36; and
• Inserting a cross-reference to the Legislation Act 2019 in respect of instruments granting or revoking an exemption to an information disclosure requirement in the principal determination, as required by section 53C(5)(b) of the Act.
