Pursuant to section 66 of the Hazardous Substances and New Organisms Act 1996 (“Act”), the Environmental Protection Authority issues the following notice.

1. Title

This notice is the Hazardous Substances (Terbufos-Containing and Prothiofos-Containing Substances Direction Prohibiting Use and Controlling Storage and Disposal) Notice 2023.

2. Commencement

This notice comes into force on 1 August 2023.

3. Interpretation

1. In this notice, words and phrases have the meanings given to them in the Act and in Regulations made under the Act.
2. In this notice, the following words have the following meanings:

Substances containing terbufos or prothiofos means any of the following substances:

Granular product containing 200g/kg terbufos approved under the Act until 1 July 2023 with approval number HSR000216;

Emulsifiable concentrate containing 500g/litre prothiofos approved under the Act until 1 July 2023 with approval number HSR000200;

4. Prohibition on Use

No person may use a substance containing terbufos or prothiofos after 1 August 2023.

5. Controls on Substances Containing Terbufos or Prothiofos until 1 December 2023

For avoidance of doubt, the controls set out for the approvals for the substances containing terbufos or prothiofos remain in effect for the substances containing terbufos or prothiofos until 1 December 2023.

6. Controls on Disposal of Substances Containing Terbufos or Prothiofos

1. All substances containing terbufos or prothiofos must be disposed of by 1 December 2023.
2. Substances containing terbufos or prothiofos must be disposed of in accordance with the controls set out for the approvals for the substances containing terbufos or prothiofos.
3. When stored for the purpose of disposal, substances containing terbufos or prothiofos must not be mixed with any other substances.
