Notice of Appointment of Receivers

Pursuant to Section 8(1) of the Receiverships Act 1993

Notice is hereby given that on 18 April 2023, Colin Gower, Licensed Insolvency Practitioner (IP20), and Diana Matchett, chartered accountant and Licensed Insolvency Practitioner (IP110), both of BDO Christchurch, were appointed joint and several receivers and managers (“Receivers”) of the Partnership by the Bank of New Zealand, under the powers contained in the:

  1. General Security Agreement dated 3 March 2014 (“GSA”); and
  2. Share Mortgage dated 3 March 2014 (“Share Mortgage”),

granted by the Partnership in respect of:

  1. in relation to the GSA, a general security interest over all the Partnership’s present and after-acquired property and all personal property in which the Partnership has rights, whether now or in the future (“GSA Collateral”); and
  2. in relation to the Share Mortgage, a mortgage over the Mortgaged Securities and Rights (as those terms are defined in the Share Mortgage) and all proceeds in respect of the same (“Share Mortgage Collateral”),

(the GSA Collateral and the Share Mortgage Collateral are together “the Collateral”).

We have been appointed Receivers in respect of the Collateral.
