Notice of Appointment of Administrators and
First Meeting of Creditors

Pursuant to Sections 239ADW(1)(b) and 239AO(1)(a) and (b) of the Companies Act 1993

Notice is given that Andrew Grenfell and Kare Johnstone, of Auckland, were appointed administrators of the companies on 5 July 2023.

A first meeting of creditors of the companies will be held at 11.00am on Tuesday 18 July 2023 at the premises of McGrathNicol, Level 17, 41 Shortland Street, Auckland. Those creditors who wish to attend the meeting remotely should contact dshaw@mcgrathnicol.co.nz advising of your intention to attend. Dial In details will be provided closer to the meeting date.

Creditors attending the meeting in person should arrive 30 minutes prior to the commencement of the meeting to facilitate registration procedures.

The purpose of the first creditors’ meeting is to decide whether to:

• appoint a creditors’ committee, and if so, to appoint its members; and
• replace the administrators.

Pursuant to clause 239AL of the Companies Act 1993 it is intended to hold a joint meeting of the companies. Should any creditor object to a joint meeting, they should send a written objection to the administrators at the address below by 12.00pm Wednesday 12 July 2023. Unless a creditor objects in accordance with this notice, the creditor will be taken to have agreed to the joint meeting.
