Notification of Amendments to Information Disclosure Determinations for Gas Pipeline Services

The Commerce Commission (“Commission”) gives public notice under the Legislation Act 2019 that it has amended the Gas Distribution Information Disclosure Determination 2012 [2012] NZCC 23 and Gas Transmission Information Disclosure Determination 2012 [2012] NZCC 24, as previously amended (“gas ID determinations”).

Summary of the Amendments

The amendments have been published in the Gas Distribution Information Disclosure Amendment Determination 2022 [2022] NZCC 17 and Gas Transmission Information Disclosure Amendment Determination 2022 [2022] NZCC 18 (“amendment determinations”).

The amendment determinations amend the gas ID determinations as follows:

  1. the definition of IM determination” is amended to make it clear that any amendments to the input methodologies (IMs) for information disclosure (ID) will automatically apply to future ID disclosures; and
  2. the definitions in Schedule 16 of the gas ID determinations that refer to a weighted average cost of capital (WACC) estimate “for the five year period” are amended to reflect our amendments to the gas input methodologies published on 25 March 2022 which enable us to set an ID WACC reflecting the length of the regulatory period for the relevant default-price quality path, and not only the usual five-year regulatory period length.
