Notice of Watershed Meeting

Pursuant to Sections 239AT and 239AU(1)(A) of the Companies Act 1993 (“Act”)

Notice is hereby given that a watershed meeting of the creditors of the company will be held (in accordance with section 239AL of the Act) at BDO Auckland, Level 4, Graham Street, Auckland 1010, at 1.00pm (NZST) on Thursday 5 May 2022.

Creditors who are unable to attend the meeting on location may attend online (Microsoft Teams) subject to providing the relevant claim form and proxy documents by due date. Please contact bri.auckland@bdo.co.nz before 1.00pm (NZST) Tuesday 3 May 2022 should you wish to attend the meeting online.

Agenda

1. To consider the administrators’ report and opinion about the company’s business, property, affairs and financial circumstances.
2. For the creditors of the company to consider and vote on whether the company should be placed into liquidation or whether the administration should end for the company.
3. Any other business that may lawfully be brought forward.

Creditors may exercise their right to vote by being present in person, or by appointing a proxy or by postal vote. Creditors attending online can only vote by submitting a postal vote form and/or proxy form. Postal votes and proxies must be received by 1.00pm (NZST) Tuesday 3 May 2022.
