Notice is given under section 173(1) of the Land Transfer Act 2017 of the following application to bring part of the dry bed of the Hekeao/Hinds River under the Act and issue a record of title for it made under section 172(1)(a) of the Act.

Application 12357894.2 by Barcoo Estate Limited, c/- Rhodes & Co, PO Box 13444, Christchurch 8141 for land at 2052 Arundel Rakaia Gorge Road, Mayfield in the Ashburton District being 12.3400 hectares, more or less, shown as part Lot 1 on LT Plan 502843 being part of the former bed of the Hekeao/Hinds River adjoining Lot 1 DP 20333 comprised in Record of Title CB1D/1173 in the Canterbury Land District.

The applicant claims to have a right under the usque ad medium filum aquae presumption and there is no other person in possession of the land with a better claim for title.

A person specified in section 174(1) of the Act may lodge a caveat under that section to prevent the application from being granted before 13 January 2023. If no caveats are lodged, a record of title will be issued in the name of the applicant.
