Notice Pursuant to Section 115 of the Land Transfer Act 2017

The applicants described below have applied under section 115 of the Land Transfer Act 2017 for the removal of a right of way at Taranaki. The applicants claim the right of way is redundant by reason of the circumstances set out below.

I intend to remove the right of way on 1 November 2022 if no objections have been received before that date. You may object by giving notice to the Registrar-General of Land by 1 November 2022.

Easement: Right of way over part Lot 1 DP 9727 coloured blue on DP 9727 in Record of Title TNB2/554 owned by Jamie Alan Shotter, Mandy Lee Thomas, part Lot 2 DP 9727 coloured yellow on DP 9727 in Record of Title TNB2/553 owned by Lynne Diane Whalley, Lot 1 DP 7449 in Record of Title TN193/82 owned by Gail Wanda Simpson, Lot 3 DP 7810 in Record of title TN209/5 owned by Darrel Bruce Chudleigh, and over Lot 4 DP 7810 in Record of Title TN206/77 owned by Laura Lesleigh Stafford for the benefit of Lot 1 LT 562061 (part of Lot 6 DP 7195 in Record of Title TN183/77) owned by Anthony Lionel Pope and Nicola Ann Pope created by Transfer instrument 89185 registered on 3 July 1953.

Circumstances: The easement is extinguished because it is redundant as the benefited land will no longer adjoin the burdened land because of subdivision plan LT 562061 (to deposit ahead of this application) and as a result, the easement has no practical effect.
