Notice Pursuant to Section 115 of the Land Transfer Act 2017
The applicants described below have applied under section 115 of the Land Transfer Act 2017 for the removal of a right of way at Taranaki. The applicants claim the right of way is redundant by reason of the circumstances set out below.
I intend to remove the right of way on 1 November 2022 if no objections have been received before that date. You may object by giving notice to the Registrar-General of Land by 1 November 2022.
Application Number: 12559916.4
Applicants: Anthony Lionel Pope and Nicola Ann Pope, c/- Young Carrington + Ussher, PO Box 845, New Plymouth 4340.
Easement: Right of way over part Lot 1 DP 11181 formerly Lot 4 DP 7292 in Record of Title TND1/671 owned by Gabrielle Lea Matches, part Lot 2 DP 11181 formerly Lot 4 DP 7292 in Record of Title TND1/672 owned by Daniel Adrian Brooks, Huatoki Trust Limited and Rachel Anne Brooks and over part Lot 3 DP 7292 in Record of Title TN185/36 owned by Hope Fletcher and Marc John Gernhoefer for the benefit of Lot 1 LT 562061 (part of Lot 6 DP 7195 in Record of Title TN183/77) owned by Anthony Lionel Pope and Nicola Ann Pope created by Transfer instrument 88204 registered on 17 December 1952.
Circumstances: The easement is extinguished because it is redundant as the benefited land will no longer adjoin the burdened land because of subdivision plan LT 562061 (to deposit ahead of this application) and as a result, the easement has no practical effect.
Dated at Land Information New Zealand, Christchurch, this 3rd day of October 2022.
C. POP, for Registrar-General of Land.
