Notice Pursuant to Section 115 of the Land Transfer Act 2017

The applicant described below has applied under section 115 of the Land Transfer Act 2017 for the removal of a Right of Way easement at Wellington. The applicant claims the Right of Way is redundant by reason of the circumstances set out below.

I intend to remove the Right of Way on 9 June 2022 if no objections have been received before that date. You may object by giving notice to the Registrar-General of Land by 9 June 2022

Easement: Right of Way over part Ngarara West A 80F showing yellow on WD 4533 in Record of Title 967289 owned by M A Developments Limited for the benefit of all of the land resulted from subdivision of formerly Ngarara West A 80A, 80B, 80C, 80D and 80E Block created by Court order 441042 registered on 4 September 1959.

Circumstances: The easement is extinguished because it is redundant as the benefited land no longer adjoins the burdened land because of subdivision on DP 71991, DP 79411, DP 82067, DP 62068, DP 83342, DP 88931, DP 88932, DP 334165, 411572 and other, and as a result, the easement has no practical effect.
