Pursuant to the Public Works Act 1981, and to a delegation from the Minister for Land Information, Nina Weir, Land Information New Zealand, hereby declares that:

1. Pursuant to section 20, and an agreement to that effect having been entered into, the land described in the First Schedule is declared road, pursuant to section 114 of the Act, and shall vest in the Wairoa District Council; and
2. Pursuant to sections 20 and 28, and an agreement to that effect having been entered into, the easement in gross described in the Second Schedule is acquired for the functioning indirectly of a road over the balance of the land in Record of Title HBP2/1275 on the terms and conditions as provided in the Third Schedule to this notice and shall vest in the Wairoa District Council

on the date of publication hereof in the New Zealand Gazette.

Right to Drain Water easement in gross marked Area A on Survey Office Plan 537655 over Part Section 37 SO 356 (balance of the land in Record of Title HBP2/1275).

Rights and Powers

The easement shall contain the rights and powers implied into the right to drain water contained in the Fifth Schedule of the Land Transfer Regulations 2018, and for the avoidance of doubt, includes the right of the Wairoa District Council to install, replace and/or upgrade drainage culverts.
